OIL SPILL CLAIM 

Have you been affected by the oil spill from the La Pampilla refinery? You may be entitled to compensation.

What is the case about?

On January 15th, 2022, around 11,900 barrels of oil were spilled during the unloading of an oil tanker at the La Pampilla refinery, north of Lima, Peru. 

Because of what is considered Peru’s worst environmental disaster in decades, fishermen and businesses are no longer able to use the ocean, employees lost their wages as businesses were forced to close and the cost of living increased due to the loss of natural resources, among other damages. 

Its purpose is to represent the interests of people who have been adversely affected by the activities of corporations, including activities that cause environmental damage or infringe on human rights. 

The SEFR aims to hold these corporations accountable for their actions.

SEFR is preparing a claim against Repsol before the Dutch courts.

The Stichting Environment and Fundamental Rights (SEFR - Fundación Medio Ambiente y Derechos Fundamentales)

Stichting Environment and Fundamental Rights (“SEFR”,or in Spanish: “Fundación Medio Ambiente y Derechos Fundamentales”) is a non-profit foundation incorporated in the Netherlands. 

Its purpose is (in short) to represent the interests of people who have been negatively affected by the activities of i.a. corporations, including activities that cause environmental damage or infringe human rights. SEFR aims to hold those corporations accountable for their actions.

How will the lawsuit be filed and how can I participate?

The lawsuit will be filed in the Netherlands by Stichting Environment and Fundamental Rights (SEFR). SEFR is a non-profit foundation incorporated in the Netherlands. Its purpose is to represent the interests of people who have been adversely affected by the activities of corporations, including activities that cause environmental damage or infringe on human rights. SEFR aims to hold these corporations accountable for their actions.

If you wish to participate in the claim, you must assign your claim to the RFHR through a Contract with the Foundation. In addition, you must provide SEFR with all relevant information regarding your situation and damages through a questionnaire. Assigning your claim will allow SEFR to file the lawsuit under its own name, but on your behalf. It is important to note that

once you have assigned your claim, you will no longer be able to file or settle your claims yourself. Only the SEFR can do this for you.

The SEFR will initiate legal proceedings against Repsol to hold it responsible for the oil spill. In addition, SEFR will attempt to negotiate a settlement on behalf of all victims participating in the claim. For this purpose, the SEFR will hire lawyers and experts. You do not need to worry about anything. The SEFR will keep you informed of the status of the proceedings.

The determination of whether the Respondents must pay any compensation, and if so, how much, will be made by (a) a judgment of the courts or (b) a settlement agreement reached between the SEFR and the Respondent(s). This is not determined by the SEFR

What are the costs of participating in the lawsuit?

The case will be presented on the following logic: no win, no fee. This means that SEFR will only charge the fee that will be explained below, if it succeeds in obtaining compensation in its favor. The claim will be externally financed. In order to file the claim, the SEFR will incur costs, such as hiring lawyers and expert witnesses. These costs are paid by an external funder. The SEFR will not charge you any money up front to participate in the lawsuit. Any person, lawyer, or organization that attempts to charge you money to secure your participation in the lawsuit is not acting on behalf of the SEFR. The SEFR will also not charge you anything if the lawsuit is lost.

Now, if the SEFR is successful in the lawsuit and in obtaining some form of compensation for your damages, the foundation will charge you a percentage of maximum 25% of the total compensation you receive. This means that if the lawsuit is successful, you will receive 75% of any compensation you receive.

paid by the defendants. The remaining 25% percentage of such compensation will be retained by SEFR. As explained above, SEFR operates on a not-for-profit basis. Therefore, this amount will not be retained by the RRFF. This percentage will be used to reimburse the funder.

If the lawsuit is unsuccessful, the SEFR will not charge you any costs. The law firms and experts involved in the case will never ask for fees directly from the victims. They will only be paid through the SEFR.
